Mrs. 498A & DV filed 498A, DV and other couple of cases against my parents, myself and my sister - together. My parents recently got AB from 498A. with strict conditions. Whereas my sister is yet to apply for AB. She is living in different state (Mumbai, Maharashtra). I have couple of queries
- Can my sister apply for AB in Mumbai, Maharastra ? Or she has to come to the state where complaints are filed and apply AB there?
SHE NEED TO SIGN ON PETITION. AB TO BE APPLIED HERE ITSELF WHERE CASE IS FILED. SHE NEED NOT ATTEND AB ONLY YOU CAN BE PRESENT TO SEEE THAT THE LAWYER IS ARGUING WELL ELSE UR PRESENCE ALSO NOT NEEDED - Can my sister go to local court in Mumbai and request to court to transfer her hearing in Mumbai ? Since she is living and working there - travelling to different state for each hearing is a nightmare for her.

- Or Is there any way where my parents lawyer also fight for her in a way so that she doesn't have to appear in court.
- Since my parents are thinking to file 482 to Quash 498A, couple of SIF member advised me that filing 482 is waste and can be counter productive. can you please she more lights on this ?
- I PERSOALLY DO NOT SUGGEST. BUT IF YOU FILE THEN ALL OTHER SHOULD GET EXCEPT THE BELOVED HUSBAND.

498A There are no provisions in law through which engagement of advocate is compulsory. Person may file or defend any case personally without engaging advocate. You may plead case of your relative in court after securing power of attorney from your relative subject to permission of council of 32 of Advocate Act.
