Jurisdiction is of course the natural habitat from where he/she used to live & was taken away.

You can of course file from their location also because as the time is so long it's better the person takes a rented accomodation near the skul & show that u are natural guardian & u stay more close.

But the biggest hurdle would be the brainwash. So kindly understand & weigh the pros & cons and act as your heart says.

There are no provisions in law through which engagement of advocate is compulsory. Person may file or defend any case personally without engaging advocate. You may plead case of your relative in court after securing power of attorney from your relative subject to permission of council of 32 of Advocate Act.

What will be the jurisdiction to file the case under IPC 361?

My kid is kidnapped and kept with in-laws from the age of 6 months and now the kid is 5 years... no access to lawful guardian..

Orders for child custody to the father are not being obeyed after the case has been decreed. 

I filed for Contempt in the High Court - was told to file Execution before the Family Court. 

The disobedience continues, and the Family Court is simply issuing notices of contempt and adjourning by months. 

Two questions: 

1. Can the Family Court punish for contempt of its orders or only refer to the HC?
2. How do I get to see my child?
