Dear gjmja:

Don't get mistaken as if all complaint's are NOT technically valid.
Complaints are valid but if the wife changes her name back to her maiden name which is completely different from her married name & also gets any govt ID (espl Voter or Aadhar) by that name & she already had a voter or Aadhar by her married name also when she was with you then this is FRAUD. This is called NAME FRAUD.

But you need to challenge it alongwith WS stage itself & NOT later.

This name fraud application must be attached alongwith WS itself & also add NO DOMESTIC RELATIONSHIP application.

nOW, IN SUCH CASES, this will prove that she is playing fraud with court, fraud with govt agencies.

After that follow those steps which has been listed at the link below.

THE ABOVE IS AN EXAMPLE.
If you find any other technicality issue with her plaint then feel free to discuss & as per me any technical issue can be hanlded in that manner if that technicality issue is grave enough as the above example else judges have immense powers. So you need to vehemently pursue whatever you feel the best but that must be legally correct also. If judge does wrong to you then feel free to ask options available.

You may plead case of your relative in court after securing power of attorney from your relative subject to permission of council of 32 of Advocate Act.

MY SMALL SUCCESS STORY

My (Complainant's) CrPC 91 has been a success after more than a year. I had to argue vehemently & the order has been passed.
I think this is FIRST TIME IN HISTORY that a complainant's CrPC 91 has been accepted. (at least as per my knowledge)
