The Notice was ultimately delivered to my mother under pressure.
The notice is not 41 notice but it says physically present in the JM Court on this date or warrant will be issued.
Later my lawyer checked with court record and found no such order.
On the basis of Notice one IA has been filed in HC where my ABA and quashing is pending along with that written one letter to JM court with a copy to IO .
everyone says court do not give such orders and IO will fall in problem.
Please advise if it is correct more ,what more can I do.

My and my mother AB rejected at session court.
Mother got AB from HC.
My AB was heard but AB was not granted but complainant was made party to it and next date in within 3 days.
I got certified copy of FIR and complaint and based on this I made complaint to NHRC,DGP,NWC,VIG.Bureau,IG and CM.
IO got changed,OC of PS transfered.
Today I got call from new IO regarding serving of 41 notice.
My quash petition date in HC is in this month.
I don't want arrest as I am in govt. service and my service will be effected.
My advocate advised to avoid notice and go underground till HC give order.
Since FIR is in other state I am getting some advantage.

two think u hv to do.
1. Try early hearing and seek arrest stay like 15 or 30days
as interm relife siting yr complaint against IO and police
manupulate .
2. In next date yr advocate must present examption and
submit HC application and seek next date .
At last make ready all bail procedure like
seurity etc if 1% u get arrested to get reguler bail on same
day.
