My wife has filled 498a ,406 and domestic voilence cases against me and my family. Everyone got bail from court.Police not arrested me .Police has only chargesheeted me.Judge has ordered a maintence of Rs 2500 .
11 months have passed so far.On every date she come into the court and takes maintence money and goes back.She is graduate . My wife is not giving her statement in the court before the judge . Is there some legal procedure by which she can bound to give her statement.My case is in evidence state. Can I give some application myself to the judge to ask her to give evidence otherwise cancel her evidence.Is there some procedure in the law for such application.
YES, Tell your lawyer to cancel her evidence. For strike off of her reply there is Order XV Rule 5 in CPC.
But to cancel her evidence in DV there must be section in CrPC which u need to check with lawyer/s else if you are PIP then you can give application yourself also.
Investing officer has not collected bills of jewellary and other items given at the time of marriage and neither my wife or her family submitted them ;either to the IO or in the court.

My wife's lawyer is BJP jila parmukh . Can I complaint against him to the bjp MP or the CM of rajasthan stating that I supported bjp in elections but what Iam getting a 498 case by bjp lawyer in return.
Yes u can but do it with FEW VALID PROOFS.
You can also complaint to BAR COUNCIL but with few big & valid proofs.
After that send RTI TO BAR COUNCIL because it comes under RTI.

498A There are no provisions in law through which engagement of advocate is compulsory. Person may file or defend any case personally without engaging advocate. You may plead case of your relative in court after securing power of attorney from your relative subject to permission of council of 32 of Advocate Act.
